Acceptable Use Policy
This Acceptable Use Policy (the “AUP”) sets out what you may and may not do when using intakto (the “Service”), operated by HumanOps B.V. (“we”, “us”). It forms part of the Terms of Service. If you breach this AUP, we may act under Section 9 of the Terms (suspension and termination).
1. Your responsibility
1.1. You are responsible for everything done under your Account, for the lawfulness of the data you give to Hermes, for the use you make of connected services, and for the actions you instruct or approve.
1.2. Where you enter personal data of other people, you must have a lawful basis to do so and you act as the data controller for that data. See the Privacy Policy and the Data Processing Agreement.
2. Prohibited uses
You must not use the Service to:
- break any applicable law or regulation, or help anyone else do so;
- infringe the rights of any third party, including intellectual property, privacy, and personality rights;
- process personal data that you have no lawful basis to process, or special-category data without meeting the conditions for it;
- create, store, or distribute unlawful content, including child sexual abuse material, content that incites violence or hatred, or unlawful harassment;
- send spam or unsolicited bulk messages, distribute malware, or run phishing or social-engineering campaigns;
- attempt to gain unauthorised access to any system, account, or data, or to circumvent security or usage limits;
- interfere with, overload, or disrupt the Service or the infrastructure it runs on, including through automated mass requests beyond ordinary use;
- use the Service to make automated decisions about people that produce legal or similarly significant effects without appropriate human oversight and a lawful basis;
- reverse engineer, decompile, copy, scrape, or resell the Service or its outputs, except to the extent that mandatory law permits;
- misrepresent the AI nature of outputs where the law requires disclosure (for example presenting AI-generated content as professional advice).
3. Connected services and automation
3.1. When you connect a third-party service (for example a messaging or email channel) and instruct Hermes to read from or act in it, you must have the right to do so and must comply with that service’s own terms.
3.2. You must not use the Service to abuse a connected service, to send messages you are not entitled to send, or to automate activity that the connected service prohibits.
3.3. You remain responsible for actions taken in connected services on your instruction or with your approval.
4. Security and reporting
4.1. Keep your credentials and access links confidential. Tell us promptly at hello@intakto.eu if you suspect misuse or a security problem.
4.2. Do not probe, scan, or test the vulnerability of the Service without our prior written consent.
5. Consequences of breach
5.1. If you breach this AUP, we may, depending on the seriousness: ask you to stop, remove or restrict access to offending content, suspend your Account, or terminate the Service under Section 9 of the Terms.
5.2. Where the law or an imminent legal or security risk requires it, we may act immediately and notify you afterwards.
5.3. Business customers indemnify us for third-party claims arising from their breach of this AUP, as set out in Section 13 of the Terms. Nothing here limits a consumer’s mandatory rights.
